Regulations on the Emblem and Flag of the Communist Party of China

(Deliberated and approved at the meeting of the Standing Committee of the Political Bureau of the CPC Central Committee on June 17, 2021 Issued by the Central Committee of the Communist Party of China on June 26, 2021)

　　Article 1 In order to regulate the production, use and management of the Party emblem and flag，Give full play to the political function of the party emblem and flag，Strengthen the Party's cohesion and combat effectiveness，Arouse Party consciousness among Party members，We will encourage the whole Party to remain true to its founding mission and to remember its mission，Firm ideals and convictions，Unite and lead the Chinese people of all ethnic groups to march forward courageously under the banner of the Party，According to the Constitution of the Communist Party of China，Enactment of these Regulations。

　　Article 2 The emblem of the Communist Party of China is a design consisting of a sickle and a hammer。The flag of the Communist Party of China is a red flag decorated with a golden Party emblem。

　　The Party emblem and flag show that the Communist Party of China is the vanguard of the Chinese working class, and at the same time the vanguard of the Chinese people and the Chinese nation. It is a Marxist political party that strives unremittingly for the happiness of the Chinese people and the rejuvenation of the Chinese nation, and for the persistence and development of socialism with Chinese characteristics and the realization of the great ideal of Communism。

　　Article 3 The Party emblem and flag of the Communist Party of China are the symbol and symbol of the Communist Party of China。

　　Party organizations at all levels and every Party member must safeguard the dignity of the Party emblem and flag。

　　Article 4 The production, use and management of the Party emblem and flag must adhere to unified standards and norms, and adhere to hierarchical responsibility and centralized management。

　　Article 5 The general scale of the diameter of the Party emblem is the following three:

　　(1) 100 cm;

　　(2) 80 cm;

　　(C) 60 cm。

　　If the Party emblem of a non-universal scale needs to be hung, it shall be appropriately enlarged or reduced in proportion to the universal scale and adapted to the hanging background and occasion。

　　Party emblem patterns are usually used in gold or red。

　　Article 6 The Party emblem or its design shall be used in the following circumstances:

　　(1) To convene the National Congress, conference of the Party and the local congresses and conferences at all levels, to hang the Party emblem in a prominent position, and to dress five red flags on each side of the Party emblem;

　　(2) Convene plenary meetings of the Central and local Party committees and hang the Party emblem in a prominent position;

　　(3) The seals (impressions) of the Central and local Party committees and their working departments, the representative organs dispatched by the Central and local Party committees in specific regions and their working departments, the Party discipline inspection organs, Party groups, and primary Party organizations, with the Party emblem engraved in the middle。

　　Article 7 When a primary-level Party committee holds a Party member congress or Party member congress, it may hang the Party emblem when necessary。

　　Party emblems can be used in the following situations:

　　(1) Certificates and logos used for important Party meetings and activities;

　　(2) MEDALS, badges, awards, certificates and other honorary documents and certificates issued by Party organizations at all levels, and relevant work certificates made;

　　(3) important publications and propaganda materials within the Party;

　　(4) The Internet websites of Party organizations at all levels;

　　(5) Party member education base, Party member vanguard, Party building propaganda column (wall), as well as Party and mass service center, Party member activity room and other grass-roots Party organization activity places;

　　(6) To carry out the Party's foreign exchanges。

　　Article 8 The general standards of the Party flag are the following five:

　　(1) 288 cm long and 192 cm wide;

　　(2) 240 cm long and 160 cm wide;

　　(3) 192 cm in length and 128 cm in width;

　　(4) 144 cm in length and 96 cm in width;

　　(5) 96 cm long and 64 cm wide。

　　Where a non-universal scale party flag is needed on a specific occasion, it shall be appropriately enlarged or reduced in proportion to the universal scale。

　　Article 9 The Party flag shall be used under the following circumstances:

　　(1) holding an oath ceremony for new Party members to join the Party, and organizing Party members to review their oath of joining the Party;

　　(2) Holding major celebrations or commemorative activities within the Party;

　　(3) The meeting rooms of the Central and local Party committees and their working departments, the representative organs dispatched by the Central and local Party committees in specific regions and their working departments, the Party discipline inspection organs, and the Party leading groups。

　　Article 10 The Party flag may be used under the following circumstances:

　　(1) To convene congresses of Party members and primary Party congresses;

　　(2) The Party's grass-roots organizations carry out theme Party days;

　　(3) Party members' education bases, Party members' vanguard posts, Party and mass service centers, Party members' activity rooms and other primary-level party organization activity venues;

　　(4) Party organization positions and Party members' commandos in the front line of important work and important projects, rescue and disaster relief, and fight against the epidemic;

　　(5) Carry out the Party's foreign exchanges。

　　In addition to the above circumstances, the Party flag pattern can be used in general with reference to the Party emblem pattern。

　　Article 11 Where special circumstances require the simultaneous flying of the Party flag and other flags, the Party flag shall be placed in the first place。

　　Article 12 Where the Party emblem and flag of non-universal scale are produced and the Party emblem and flag and their designs are used outside the prescribed circumstances, they shall be reported to the Party committee organization department at or above the county level for approval。

　　Article 13 The Party emblem and flag and their designs shall not be used for:

　　(1) trademarks, designs for which patent rights are granted, and commercial advertisements;

　　(2) Private activities;

　　(3) Markers of private places and personal cyberspace;

　　(4) personal daily articles and daily life furnishings;

　　(5) other unsuitable places, circumstances and environments。

　　Article 14 No words, symbols or patterns shall be added to the Party emblem and flag, no damaged, deface or faded Party emblem and flag shall be used, and no Party emblem or flag shall be made or used that does not conform to the instructions of the Law attached to these Regulations。It is not allowed to hang, insert or otherwise display or use the Party emblem and flag in a way that undermines the dignity of the Party emblem and flag。

　　Party emblem and flag shall not be discarded at will。Party emblems and flags that are damaged, defaced, faded, marked characters and symbols, etc. that do not conform to the provisions for the production and use of the Party emblem shall be recovered and disposed of in accordance with the provisions。After major celebrations or commemorative activities are held within the Party, the Party emblem and flag used at the event site shall be recovered or properly disposed of by the relevant units in accordance with the principle of who issues it and who is responsible。

　　Article 15 After the death of a Party member, with the consent of the grass-roots Party committee of the unit to which the Party member's organizational relationship belongs that has the relevant examination and approval authority, the Party flag may be covered on the body or urn, provided that the Party flag shall not touch the ground, shall not be cremated with the body, and shall not be buried with the urn。

　　Article 16 The use of the Party emblem and flag pattern on the Internet and in publications shall be placed in a prominent position。

　　The standard version of the Party emblem and flag pattern used in the network and publications is published on the Communist Party website and the Communist Party of China News Network。

　　Article 17 Knowledge of the Party emblem and flag shall be an important part of the Party history education, Party member education and training, and the training of active party members。

　　Party organizations at all levels shall educate Party members, Communist Youth League members, Young pioneers and the masses to understand the historical and spiritual connotation of the Party emblem and flag, consciously regulate the use of the Party emblem and flag and its patterns, and respect and care for the Party emblem and flag。

　　All news and publishing units shall strengthen the publicity of the knowledge of the Party emblem and flag, report and use news and pictures containing standardized Party emblem and flag patterns, and maintain the image of the Party。

　　Article 18 The Party emblem and flag shall be made in accordance with the instructions of the Law on the manufacture of the Party Emblem and Flag of the Communist Party of China attached to these Regulations。The production enterprise shall be determined by the Organization Department of the Party Committee of the province (autonomous region, municipality directly under the Central Government) among the enterprises with production qualifications。No unit or individual shall make Party emblems and flags without approval。

　　Article 19 The Party emblem and flag should in principle be centrally equipped and issued, so that a party committee has a party emblem and a branch has a party flag, and the required funds can be deducted from the party fee。

　　Article 20 Party organizations at all levels shall regard safeguarding the dignity of the Party emblem and flag as a political task and earnestly fulfill their principal responsibilities。Party committees at or above the county level organize departments to perform supervision and management responsibilities for the work of the Party emblem and the Party flag of their respective units and systems in their respective regions, and strengthen supervision and management of the production, sale and commercial use of the Party emblem and the Party flag together with the market supervision and management department。

　　Enterprises and individuals who illegally produce and sell products of the Party emblem and the Party flag shall criticize and educate and promptly correct the acts of using the Party emblem and the Party flag and its patterns in violation of these Regulations. If the circumstances are serious or if they refuse to correct them, they shall be dealt with in accordance with the relevant provisions, and the suspected illegal crimes shall be dealt with according to law。

　　Article 21 The Central Military Commission may formulate relevant provisions in accordance with these Regulations。

　　Article 22 The badge of a Party member is the identity mark of a Party member, and its production, use and administration shall be prescribed separately。

　　Article 23 The Organization Department of the CPC Central Committee shall be responsible for the interpretation of these Regulations。

　　Article 24 These Regulations shall go into effect as of the date of promulgation。Previously issued provisions on the Party emblem and flag, where inconsistent with these Regulations, in accordance with these Regulations。
